The lawyers of Yanukovych hinted that pull the GPU to the court’s refusal to question him in Russia
Protection deprived the title of President Viktor Yanukovych accused the Prosecutor General of Ukraine in violation of the law because of refusal to interview him in Russia.
This was stated by his lawyer Vitaly Serdyuk.
“Protection of Viktor Yanukovych surprised by the refusal of the Prosecutor of the GPU Ruslan Kravchenko from interrogation of Viktor Yanukovych in Russia, as in December 2016 the General Prosecutor’s office itself initiated before the Russian side the conduct of the investigative procedure, in the manner of international cooperation, namely the European Convention on mutual legal assistance in criminal matters of 20 April 1959”, – he stressed.
As the lawyer said of Yanukovych, Prosecutor General’s office of Ukraine refuses the questioning of his client, on the territory of Russia against the decision of Pechersk district court, who is obliged to interrogate the place of residence.
“Obviously, they are not interested in the truth in the case. If the GPU will continue to avoid cooperation with the state enterprise of the Russian Federation in the framework of international law under the Convention, it will be the basis for the application of the mechanism of prosecution of the officials of the GPU to criminal liability for failure to execute judicial decisions”, – said Serdyuk.
In addition, he recalled that the Prosecutor General’s office officially confirmed the address of the residence of Viktor Yanukovych in his letter to the Ukrainian colleagues.
“We have provided this address to the employees of the GPU 27 August 2015, however, all this time the GPU had ignored this information. Hopefully, official confirmation from the GP of Russia in the end will put an end to the question of the whereabouts of Viktor Yanukovych and the GPU stop to avoid our customer. Moreover, since the location of the client once again confirmed the need to further his search has disappeared and we will initiate its termination”, – the lawyer added.
Also the lawyer noted that without proper implementation of international procedures for employees of GPU, the court will not have the right to initiate in absentia proceedings, as it will be a gross violation of the rights of the client to protect in the future will be a serious basis for cancellation of any court decisions to the ECHR and bringing judges to criminal liability for making a knowingly unjust decisions.
We will remind, the state office of public Prosecutor of the Russian Federation expressed readiness to organize the interrogation of former President of Ukraine Viktor Yanukovych on the territory of Russia in the presence of Ukrainian investigators.
Earlier , Yanukovych said that had a number of questions to the GPU is relatively open against him of high treason. Yanukovych said that is not properly received suspicion of treason, and therefore asked not to consider himself a suspect. This is stated in the letter by the former President to the Pechersk court on January 18.
Suspicion Yanukovych has declared the public Prosecutor of Ukraine Yury Lutsenko during video interrogation of a former head of state. At the same time, Lutsenko said that he will pass the documents to the lawyers who attended the hearing, and will give properly in Rostov. Note that the main argument of the prosecution was a letter from Yanukovych to Putin asking for military support.
