Ukrainian company challenged the tariff for gas transit through the territory of the country.

July 6, 2018 “Naftogaz of Ukraine” filed in the Stockholm arbitration claim to revise the tariff for the transit contract with “Gazprom”. This reports the press service of the Ukrainian company.

In the “Naftogaz” explained that the contract between the two companies allows them to demand revision of the tariff, if the European gas market has undergone significant changes and if the rate does not correspond to the European level. “In its decision of 28 February 2018 the Stockholm arbitration court for procedural reasons dismissed the claim “Naftogaz” on the revision of the tariff. Thus, the requirement of “Naftogaz” on the revision of the rate in fact remained unresolved,” explained the claim in the NAC.

The court ruled that the Russian company should compensate the Ukrainian more than four and a half billion dollars for short-delivered gas for transit from 2009 to 2016. According to the court, part of the money will be credited for gas supplies in 2013 and 2014. The remaining amount, which is more than two and a half billion, “Gazprom” to compensate the money.

But the Russian gas monopoly “has taken on the negotiations of the non-constructive position, forcing Naftogaz to seek arbitration as provided by the contract.” Therefore, “Naftogaz” requires a revision of the tariff, since March 2013.
