Naftogaz disputed the resolution of the European Commission about the capacity of gas flows, Russia to bypass Ukraine

“Naftogaz of Ukraine” filed in the General court of the European court of justice lawsuit against the European Commission with a demand to cancel the decision, which allows the Russian “Gazprom” to increase the use of capacities of the OPAL gas pipeline and increase the volume of pumping gas “Northern stream”.

The claim was sent to court on March 27. According to “Naftogaz”, the decision of the European party in violation of article 274 of the Association Agreement between Ukraine and the EU as well as EU commitments under the Treaty on the Energy Charter and the Treaty establishing the Energy community.

Naftogaz argues his claim that the decision was beyond the powers of the Commission. Recall, 25 October 2016, the European Commission gave permission to the Russian “Gazprom” to increase gas transportation to the EU through the pipeline OPAL. It is part built to bypass Ukraine – Nord stream and runs across Germany from the Baltic sea to the city brand, on the border with the Czech Republic.

Polish company PGNiG on December 4 made a legal claim to the Tribunal of justice concerning the abolition of the European Commission decision on increase in capacities “Nord stream”. The plaintiff is convinced that the European Agency has violated the principle of competition in the gas market of the EU, the principle of legal certainty, the principle of third party access, the principle of proportionality and the provisions of the agreement EU-Ukraine.

On 27 December, the European Court of justice ruled to suspend the decision of the European Commission regarding the increase of access “Gazprom” to the OPAL pipeline is one of the branches of the “Nord stream”.
