Austria refused to arrest funds Klyuev because of alleged political persecution – Gorbatyuk

In Austria, the seizure of money of an official of the fugitive sees political motives.

Head of the Department of special investigations of the Prosecutor General of Ukraine Serhiy Gorbatyuk claims that Austria refuses to arrest the funds of the former head of the presidential Administration Andriy Klyuyev, because he sees this as a political prosecution, UNIAN reports.

“Thanks to the European sanctions is part of the funds that have been blocked in foreign countries, and we are grateful for it. But when we move to the next stage – the seizure of funds by the decision of Ukrainian judges, there have been cases of refusal of foreign countries to arrest those funds,” he said.

In Austria, the seizure of money of an official of the fugitive sees political motives.

“This is the case with Austria, where the funds Klyuev refused to arrest because seen signs of political persecution on the part like Ukraine. In our opinion, these accusations are unfounded,” – said Gorbatyuk.

He also noted, another issue in the interaction between law enforcement agencies at the international level is a requirement from those countries where discovered, deduced from the Ukraine means that Ukraine has proved that the money obtained by criminal means.

Mr. Yan added that, according to Ukrainian legislation, Ukraine can seize the funds for the next step, which will be forfeited if these funds belong to the suspect. “But other countries do not accept this. They say, only prove to us that they obtained by criminal means”, – said Gorbatyuk.

Recall that on 6 March 2014, the EU has applied economic sanctions against former President Viktor Yanukovych, former interior Minister Vitaly Zakharchenko, ex-Prosecutor General Viktor Pshonka, ex-head of SBU Alexander Yakimenko, the former first Deputy head of presidential Administration Andriy Portnov, ex-Minister of justice Elena Lukash, the former Deputy Prime Minister Serhiy Arbuzov, former head of the presidential administration Andriy Klyuyev and his brother Serhiy Klyuyev and others.

In March 2015, Yakimenko, Alexei Azarov and Kalinin excluded from the sanctions list. Instead, the list includes former first Deputy Prime Minister Serhiy Arbuzov, MP Yuriy Ivanyushchenko, former Minister of revenues and duties Oleksandr Klymenko, and former energy Minister Eduard Stavytskyi.

In addition, on 8 January came into force the decision of the court of the EU on the lifting of sanctions against the former first Deputy head of AP Andrey Portnov. Case Portnov lasted nearly the entire 2015. In February last year, the former official complained to the ECJ that the GPU falsified documents about the embezzlement of state funds. 26, 2015, the court of justice recognized the groundless sanctions against Portnov , and withdrew the arrest of his property.

On 28 January it became known that a number of officials, Yanukovych won the case in the EU court to lift sanctions. We are talking about two Azarov, Arbuzov and Klyuyev Stavisky.

However, the GPU was assured that sanctions against them continue to operate. The fact that the decision of the court of Luxembourg has abolished the sanctions imposed on some Ukrainian officials on 6 March 2014 with a duration of a year. In the spring of 2015 were imposed new sanctions up to March 2016, which has not been canceled.
