Glad has improved the mechanism of rehabilitation of victims of repressions of the Communist regime

Rada adopted the draft law which provides for the restoration of the rights of victims of repressions of the Communist totalitarian regime 1917 – 1991.

He was supported by 245 MPs.

According to the explanatory note to the “Draft Law on amendments to some legislative acts of Ukraine concerning improvement of the procedure of rehabilitation of victims of repressions of the Communist totalitarian regime 1917 – 1991”, it is designed with the purpose of restoration of rights of persons who have been convicted in court and convicted for offences which are not considered crimes in a civilized society.

The bill amends the Law of Ukraine “On rehabilitation of victims of political repressions in Ukraine” and other legislative acts of Ukraine in the field of rehabilitation of victims of repressions of the Communist totalitarian regime 1917-1991 to improve the rehabilitation process and ensure its conformity to the current legislation of Ukraine.

It is noted that the old law does not contain clear definitions of certain terms and concepts that are used in it and relate to specific forms of political repression, the motives of political repression, extrajudicial authorities.

“The absence of such definitions greatly complicates the decision-making process by the competent authorities on the results of the review of criminal cases of the Soviet period, and in some cases even creates the conditions for arbitrary interpretation of certain provisions of the Law, leading to violation of rights and lawful interests of victims of political repression”, – stated in the note.

We will remind, in 2015, the Rada supported the law on the recognition of soldiers of the organization of Ukrainian nationalists (OUN) and the Ukrainian insurgent army (UPA) as fighters for Ukraine’s independence.
