The court ordered the GPU to register a case on the issuance premium weapons Avakov
The Pechersky court of Kiev ordered the GPU to be registered in ERDR, a criminal proceedings on the fact of the issuance premium weapons, interior Minister Arsen Avakov.
This is stated in the court’s decision, the text of which is received at the disposal of “Ukrainian news”.
As reported, Avakov gives premium weapons, referring to the Disciplinary regulations of the APU, which applies to active military, military reserve, border guards and Sbushnikov. It is noted that this does not apply to the head of the Ministry of internal Affairs and civilians. the Ministry, however, has its own “Disciplinary Statute of bodies of internal Affairs”, which allows you to deliver premium firearms exclusively “to persons of commanding structure of bodies of internal Affairs”.

Reporters noted that in 2015 Avakov issued an order approving the new edition of the Regulations on departmental incentive award of the Ministry of internal Affairs “Firearms”, where instead of the Disciplinary Statute of bodies of internal Affairs referred to the Disciplinary Charter of the Armed forces. The Agency notes that the order of the Minister may not cancel the norm of the Statute having the force of law and enacted by Parliament and obliged to act only on the basis, within powers and in a way stipulated by the Constitution and laws — that is, the Charter of the Ministry of interior.

The court decision States that had rejected the arguments of the representatives of the GPU supposedly “presentation edition in full of the elements of the offense” and ordered the prosecution to investigate.
“The law imposes on the applicant the obligation to fully reproduce the statement about the criminal offense all the elements of the offense, fairly presenting objective elements of a crime”, — reported in the document.
