Yanukovych appealed to the NEB and the GPU with complaints against judges in the case against him

Stripped of the title of President Viktor Yanukovych submitted to the Prosecutor General and the NAB allegations of involvement of three judges of the Obolonsky district court to criminal liability for making a knowingly unjust decisions.

This was stated by the lawyer of ex-President Vitaliy Serdyuk, reports Ukrainian Pravda.

“Such decisions which are unfair, become, first, acceptance to consideration of the case in which there is neither a suspect nor a defendant, and which has since passed the period of investigation. Second, the court refused to ensure the participation of Viktor Yanukovych in the process in accordance with the requirements of the European Convention on mutual legal assistance in criminal matters and Chapter 43 of the code of Criminal procedure of Ukraine”, – he said.

In addition, according to him, the court adopted the decision on the beginning of the correspondence procedure of the investigation without regard to Viktor Yanukovych and submitted by the defense evidence.

The court also completely ignored the European Convention for the protection of human rights and fundamental freedoms of the individual in terms of ensuring access to justice.

“We believe that such decisions are accepted by the court as a result of the unprecedented pressure on him”, – said Serdyuk.

According to him, in April 2017 was a special intervention into the automated system of allocation of judges to ensure pressure.

We will remind, Yanukovych will complain of Ukraine to the European court of human rights. According to the lawyer of Seruka, Yanukovych will complain about the violation of Ukraine’s rights to access to justice and protection. Serdyuk promises that the claim will be sent to the ECHR within one month. Protection ex-the President of the fugitive believes that the court’s decision about the beginning of the trial in absentia against Yanukovych is the de facto denial of his right to participate in the process.

July 6, the lawyers of Viktor Yanukovych, Vitaliy Serdyuk and Igor Fedorenko announced their withdrawal from the trial in the Obolon district court of Kyiv. The defenders of the fugitive stressed that July 6 will not participate in the hearing because Yanukovych wrote a statement that waives their services.

As previously reported, Obolon court of Kyiv allowed the special court proceedings in the case of Viktor Yanukovych. This resolution provided for the absence of Yanukovych, who would have to go with the court on the Skype connection. In absentia proceedings, the prosecutors insisted.

In November 2016, the Prosecutor General Yuri Lutsenko announced the suspicion of treason Viktor Yanukovych in the premises of Sviatoshynsky court, being in direct contact with the Rostov court, where the President is a fugitive. Yanukovych is accused of committing treason, aiding the authorities of the Russian Federation, intentional acts committed for the purpose of modifying the boundaries of the territory and the state border of Ukraine.
